By using the Flowverse NFT marketplace, you are automatically enrolled in the Flowverse XP program (“Program”) provided by Flowverse Pty Ltd (“Flowverse,” “we,” “our,” or “us”). Please read these terms and conditions (“Terms”) carefully. Your continued use of the Flowverse NFT marketplace constitutes your acceptance of these Terms and any additional terms and conditions provided by Flowverse. If you do not agree to these Terms, please refrain from using the Flowverse NFT marketplace.

1.1 Flowverse XP (“FXP”) is an experimental points system designed to reward loyal users of the Flowverse NFT marketplace.

2.1 You can earn FXP through the following activities:
- Buying NFTs on Flowverse NFT marketplace: Each US$1 spent is eligible for earning 1 FXP. FLOW token transactions will be converted to USD at the time of transaction.
- Selling NFTs on Flowverse NFT marketplace: Each US$1 earnt from selling an NFT is eligible for earning 1 FXP. FLOW token transactions will be converted to USD at the time of transaction.
- Get your FXP boosted with a Flowverse Mystery Pass: If you own one or more Flowverse Mystery Pass NFTs, you will earn additional FXP for every eligible transaction according to the schedule below.
• 10% more FXP if you own 1 Mystery Pass
• 20% more FXP if you own 2 Mystery Passes
• 30% more FXP if you own 3 Mystery Passes
• 40% more FXP if you own 4 Mystery Passes
• 50% more FXP if you own 5 Mystery Passes
• 60% more FXP if you own 6 Mystery Passes
• 70% more FXP if you own 7 Mystery Passes
• 80% more FXP if you own 8 Mystery Passes
• 90% more FXP if you own 9 Mystery Passes
• 100% more FXP if you own 10 or more Mystery Passes

3.1 The potential rewards and benefits of FXP may include NFTs and/or fungible tokens. Specific details of rewards and benefits will be communicated to participants separately.

4.1 The Program's first season, Genesis Season One, is currently live. Any rewards and benefits will be distributed following the end of the season.

4.2 Given the experimental nature of Flowverse XP, the end of season one could occur at any time this year. Flowverse reserves the right to determine the duration of each season and modify the season end date as deemed necessary.

5.1 To view your Flowverse XP and check your ranking, you must connect your wallet to the Flowverse NFT marketplace. Your Flowverse XP and ranking will be visible in the balance and My Collection section.

6.1 Flowverse XP will accrue separately for each wallet. While using multiple wallets is permitted, engaging in activities such as gaming the system or wash trading is strictly prohibited. Flowverse reserves the right to disqualify Flowverse XP earned through such activities at its discretion.

7.1 We also aim to reward our earliest users. Your initial score will be reflected when you sign in to the Flowverse NFT marketplace and will be calculated based on all the transactions (purchases and sales) you have made since January 27th, 2023.

7.2 The Flowverse Mystery pass boost is only applicable for new transactions after the launch of the Flowverse XP program. The boost is applied based on the current number of passes owned at the time the transaction is processed.

8.1 Flowverse reserves the right to modify or update these Terms and Conditions at any time without prior notice. It is your responsibility to review these Terms periodically for any changes. Continued use of the Flowverse NFT marketplace and participation in the Program after any modifications or updates shall constitute your acceptance of the revised Terms.

9.1 Flowverse reserves the absolute right to cancel, suspend, or terminate the Program at any time, for any reason, without any obligation to distribute rewards or benefits to participants.

10.1 Flowverse reserves the right to modify all aspects of the Program, including but not limited to the FXP earning methods, FXP reward calculations, FXP duration of seasons, and rewards and benefits offered. These modifications may occur without any prior notice or consent from participants.

11.1 Flowverse has no obligation to provide any rewards or benefits associated with Flowverse XP, even if participants have accrued a certain amount of Flowverse XP. Flowverse reserves the right to withhold or revoke rewards without consequences.

12.1 These Terms and Conditions, along with all other policies and agreements governing the use of the Flowverse NFT platform and its services, including the Terms and Conditions and Privacy Policy, are governed by and construed in accordance with the laws of Melbourne, Australia. Any disputes arising from or related to these Terms and Conditions shall be exclusively subject to the jurisdiction of the courts in Melbourne, Australia.

13.1 These Terms and Conditions govern the Flowverse XP program as a supplemental agreement to the existing Privacy Policy, Terms and Conditions, and other policies on the Flowverse NFT platform.

14.1 Flowverse XP is intended to be an off-chain rewards program. It is important to note that Flowverse XP is not a fungible token and does not have a separate market value or tradeability outside of the Flowverse NFT platform. Flowverse XP is solely intended for the purposes of the Flowverse XP program and cannot be exchanged or transferred to other users or platforms.

15.1 Flowverse Pty Ltd, its directors, shareholders, and any other relevant parties shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with the Flowverse XP program. This limitation of liability applies to any claims, losses, or damages, whether based on contract, tort, strict liability, or any other legal theory, even if Flowverse has been advised of the possibility of such damages.

16.1 In the event that any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions.
